MINUTES OF A MEETING of the St Goran Parish Council held on 5th January 2012 in the St Goran Church Schoolrooms at 7.30pm. with Mr P Grose in the Chair.

Present were Messrs Ayres, Bullen, Church, Lobb, Husband, Trevarton, Mrs Dean, Mrs Stokes, County Councillor Mutton and 4 members of the public.

1.  APOLOGIES

3. PUBLIC SESSION

 

Members of the public spoke of their recent planning application on their house, 'Byways'. They informed the PC that the original application has been withdrawn, in line with CC's recommendation. This will allow them to modify the plans by reducing the roof height, which would have originally caused CC to refuse the application and also the reason for the PC's objection. Mr Grose thanked the Boothroyds for attending the meeting.

A member of the public informed the meeting that herself and another have looked into  registering the memorial curtilage under the PC with the land registry, but have discovered that the land registry will not advise them on the work required and therefore feel they are unable to carry out this process. Therefore the member of the public has contacted a locally retired solicitor, who  suggested that he could assess the matter free of charge, in order to advise the PC whether the curtilage ownership can be claimed. Once the advise and a quote for the cost of the advised course of action has been received, the PC could then decide whether to instruct a locally recommended solicitor to carry out this work on their behalf.

 

The Parish council then went into formal session.

4.  MINUTES OF THE MEETING OF THE 1st DECEMBER 2011

Mr Husband was not present at the meeting. The minutes were corrected and then agreed.

5.  MATTERS ARISING FROM THE MINUTES

 

5.1 Memorial Curtilage – Land Registry

Mr Trevarton raised his concerns about non PC members carrying out work on behalf of the PC. To overcome this Mr Grose proposed to form ' The Parish Council War Memorial sub committee' with Co-opted members of Mrs Miles and Mrs Tonkin, to be Chaired by Mr Grose, substitute chair Mr Church and Mrs Dean and Mrs Stokes as members, with any cost to be reimbursed by the PC. Mr Trevarton seconded the proposal and all were in favour.

Mr Grose proposed that the PC War Memorial Sub Committee gain legal advice from a named retired solicitor and a quote for the cost from a locally recommended practising solicitor if the PC decided to carry out their recommendations. It was also proposed to inquire about alternatives, such as registering the memorial curtilage as a village green.

5.2 Public Convenience Review

The resident who previously wrote to Mr Gilbert MP has received a reply supporting the community. The resident also understands that the decision has been put on hold for 12 months and that CC Mutton only attends half of the cabinet meetings, and is concerned that the views of our village may not be fully conveyed at this meeting. He informs the PC that petitions are currently available in three places around the village and suggests that these petitions could be directed to the chairman of Cornwall cabinet together with a letter from the PC.

Rt Hon Eric Pickles MP, Secretary of State for Communities and Local Government, understands that CC have postponed their plans pending a full consultation.

Department of Communities and Local Government have urged local Councils to protect frontline services, which may mean innovative solutions at a local level which may mean these facilities can be retained for visitors and recommend that the PC seek legal advise as to whether these conveniences can be run by the PC for a charge under existing legislation.

The Clerk to place a notice in the Parish Magazine that the PC still have concerns  over the possible public convenience closure in Gorran Haven and suggest that all local businesses keep the current petition in constant use in preparation for any further threats to this amenity.

5.3 Highways – Gorran Signage, Crooked Lane & Sheeps Lane

Gorran Signage – As the highways budget has been dedicated to warning signs replacing the sign can only be put on the list for the future, but a claim for the cost could be sought if details of the accident were discovered. Enquiries with the police have shown that they do not have a record of the incident although they are said to have attended.

Crooked Lane – This will be hand swept by Serco.

Sheeps Lane – The fly tipping has been reported to Serco.

The overgrown heather on the triangle cannot be cut by Highways.

The Clerk to write to The Friends of the triangle to ask them to address the problem.

A meeting has been arranged with Teresa Frost at the Barley Sheaf car park at 12.30pm on Friday 6th January. Mr Lobb and Mrs Tonkin will attend.

5.4 Footpaths – Cliff Road and Boswinger

The Countryside Ranger is monitoring the furniture along the coastal path leading from Cliff Road as various items are starting to wear.

The missing sign post at Boswinger has been placed on the Countryside Rangers work programme, but is a low priority.

5.5 St Goran Playing field Trust – Golden Jubilee proposal

The Playing field Trust Committee members have been informed of the proposal and it will be discussed at their next meeting on 10th January.

6 COMMITTEE REPORTS.

 

6.1 Footpaths.

The stile at Rescassa still has not been replaced and could be a danger to the public. The Clerk to write to the Chairman of CC expressing the PC's concerns and that this matter was brought to the Country Side Ranger's attention a number of years ago.

7 CORRESPONDENCE

 

7.1 Countryside Ranger – Land to be dedicated to Highway

Copy of a map showing an area of land that Caerhayes Estate want to be dedicated to highway in order to widen the road to accommodate coaches gaining access to the estate.

7.2 Cornwall Council – Council tax precept referendums

It has been announced that Parish Councils will not be subject to capping or referendums on their council tax precepts for 2012/13.

7.3 Cornwall Council – Consultation on Performing Arts Library

The consultation is being undertaken about the service provided by the Performing Arts Library, an on line survey is available with a deadline of 22nd January.

7.4 Defra – Revised Bathing water directive

According to the new Bathing Water directive it is understood that the PC is the bathing water controller for Gorran Haven and Little Perhaver, i.e the owner/leaseholder, and will be responsible for providing information signage as required. The recommended text for a sign has been provided along with, an explanatory letter and public information quick guide. Defra will pay £390 towards signage. Can the PC confirm that they are the bathing water controller as defined in the Bathing Water Regulations 2008 and that we will provide public information as required, so payment can be authorised.

From May 2012 designated bathing waters must display information on water quality during the bathing season to comply with the Bathing Water Directive.

 

If the PC may wish to keep using the weekly results poster this will be supplied until 2014.

 

The Clerk to contact CALC for advise as to whether the PC should be be responsible for the bathing waters displays.

7.5 Cornwall Rural Community Council – Rail Transport Survey

CRCC would be grateful if the PC could complete their on line survey to identify peoples views on rail transport in the Duchy.

Mr Trevarton offered to complete the survey.

7.6 Rural Services Network – Rural funding formula review

Following a recent consultation on proposals for Councils to keep a share of business rates, the Government is to review the formula it uses to decide how much money local authorities receive to provide rural services.

7.7Cornwall  AONB – Annual Forum

Cornwall AONB will be holding forums annually for the next three years to discuss issues of importance to everyone. A date has been set for 17th March, venue to be confirmed.

7.8 Cornwall Council planning – Mount Zion Church appeal against planning refusal

An appeal has been made in respect of Mount Zion Church. Any previous comments made during the original planning application will be taken into consideration. If the PC wish to withdraw their comment or make further representations, this must be done with in 6 weeks of the appeal start date of 21st December.

The Clerk to confirm the PC's original support for both applications for dormer's and velux windows.

PA11/10034: Mrs Sheila Beesley, Gorran Haven Institute. Erection of extension and improvements to disabled access. Full Planning.

Support The PC still have concerns about surface water running off the entrance to the site, creating further deterioration to the road surface of Foxhole Lane.

Mr Ayres and Mr Bullen abstained. Mrs Dean no vote.

All the Bills for November have been paid. Agreed to pay the bills for December. The Clerk presented the actual receipts and payments to date, which were compared with the yearly budget.

 

10 Tourist Brochure Spaces

The tourist brochure currently has 4 unused spaces. The PC gave the Clerk suggestions of a few local businesses to approach.

11 Standing Orders

Standing Order 8.1 add ' which may include a minority of Co-opted members. This is to be checked with CALC.

Appendices to include – Cemetery policy and Code of Conduct.

Standing Order 1.3 typing error to be corrected.

The Clerk to make adjustments and Standing Orders to be reviewed at the next meeting.

12 Memorial Headstone  - Permission

Permission granted to Larcombe's memorials to erect 2 new memorial headstones at St Goran Cemetery.

13. PARISH PROBLEMS

The persistent flooding along Portheast Way was reported to Highways during the month. A crew with a TV camera are due to investigate the drainage pipes.

The junction of Crooked Lane and Vicarage corner are covered in leaves and the tarmac on the road entering Gorran is in a bad state of repair, as are many roads in the parish.

The footpath from Gorran to Menagwins corner has not been cut back.
